Unemployed man gets suspended jail term for reposting call to boycott Legco poll

An unemployed man has received a suspended jail sentence for reposting a social media post by a fugitive inciting the Hong Kong public to boycott the Legislative Council election last year.

Before suspending the punishment for 24 months, West Kowloon Court on Monday handed down a two-month jail term to Lam Kin-sik, 67, after he admitted to violating the Elections (Corrupt and Illegal Conduct) Ordinance.

During the election period between October and December 7, 2025, Lam shared a post from fugitive Tong Wai-hung on his social media page, urging people not to vote in the election.

Tong is wanted by the Independent Commission Against Corruption (ICAC) after he published that post. The agency said he had left Hong Kong and issued a warrant for his arrest.

Reposting Tong’s illegal content was deemed as inciting others not to vote, according to the anti-graft watchdog.

Magistrate Shirley Cornelia Hung said a custodial sentence was inevitable given the serious nature of the offence, but she decided to suspend the jail term for two years after considering Lam’s timely guilty plea and health condition.
