Police said on Friday that the force was alerted at noon on Wednesday that a man was suspected of swimming at a closed public beach on Castle Peak Road in Tuen Mun while the signal was in effect.
Officers arrived at the scene and issued a warning to the man, who subsequently left the beach, police said.
After further investigation, officers of the Castle Peak division on Friday applied to the court for a summons to prosecute the 54-year-old man for the suspected violation of the Bathing Beaches Regulation under the Public Health and Municipal Services Ordinance, according to police.
Under the ordinance, any failure to comply with the temporary closure arrangements is an offence and carries a maximum fine of HK$2,000 (US$257) and imprisonment of up to 14 days upon conviction.
On Thursday, police arrested two women for allegedly bringing an eight-year-old boy to take selfies and film the stormy seas at the South Horizons housing estate on Wednesday while the No 10 signal was in effect.
